Music & Gigs (“we”, “us”, “our”) is committed to protecting your privacy. This policy explains what information we collect, how we use it, and your rights in relation to it. It applies to all Music & Gigs websites and services regardless of where you are located.

Who we share your data with

We do not sell your data to third parties. We use the following services which may process your data on our behalf:

  • Mailchimp— newsletter delivery and management
  • Google Analytics— anonymised site usage analytics
  • Cloudflare— website security and performance
  • Hetzner Cloud— image and file storage

How long we keep your data

We keep your email address for as long as you are subscribed to our newsletter. You can unsubscribe at any time using the link in any email we send. Comments are kept for as long as the article they appear on remains published.

Cookies we use

We use a small number of cookies for the following purposes:

  • Analytics— Google Analytics sets cookies to help us understand how readers use the site. This data is anonymised and we cannot use it to identify individual visitors.
  • Preferences— we set a cookie to remember your region preference (NZ, UK or Global) and whether you have dismissed the location banner, so you don’t see it every visit.
  • WordPress— session cookies are set only if you are logged in as a site administrator. These are not set for regular readers.
  • Newsletter— Mailchimp may set cookies if you interact with our newsletter signup form.

Managing cookies

You can control and delete cookies through your browser settings. Disabling cookies may affect how parts of the site work — for example your region preference will not be remembered between visits. To opt out of Google Analytics tracking, you can install the Google Analytics Opt-out Browser Add-on.

Terms & conditions

These are the terms and conditions (“Terms”) that apply to your use of Music & Gigs and all associated websites and services (“the Site”), which is operated by Music & Gigs (“we”, “us”, “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please stop using the Site immediately.

We reserve the right to update these Terms at any time. Your continued use of the Site following any change constitutes your acceptance of the updated Terms. We recommend checking this page periodically.

1. Your obligations

By using the Site, you agree that you will not:

  • Use the Site for any unlawful purpose or in violation of any applicable laws or regulations
  • Upload, transmit or distribute any computer viruses, malware, or any code designed to interfere with the normal operation of the Site or any other system
  • Submit or transmit any material that is defamatory, offensive, obscene, threatening, harassing, or otherwise objectionable
  • Infringe the intellectual property rights, privacy rights or any other rights of any third party
  • Copy, reproduce, republish, distribute or commercially exploit any content from the Site without our prior written consent
  • Create or publish any hypertext link to any part of the Site without our prior written consent
  • Attempt any unauthorised access to any part of the Site, its servers, or any connected systems
  • Modify or alter any part of the Site other than as necessary for its intended personal use
  • Use the Site for any commercial purpose without our prior written agreement
  • Engage in any conduct that could damage, disable, overburden or impair the Site or interfere with any other user’s enjoyment of it

You agree that if you have any right, claim or action against any other user of the Site arising from their use of the Site, you will pursue it independently and without any recourse to us.

2. Our rights

We reserve the right to:

  • Modify, suspend or withdraw the Site, or any part of it, temporarily or permanently, with or without notice. We will not be liable to you or any third party for any such modification, suspension or withdrawal
  • Change these Terms at any time. Your continued use of the Site constitutes acceptance of any changes
  • Monitor any activity and content on the Site and investigate any reported violations of these Terms or any complaints
  • Remove any content from the Site at any time and for any reason, without notice and without liability to you
  • Restrict or terminate your access to the Site at any time if we consider that you have breached these Terms or engaged in conduct that we deem inappropriate

3. Content ownership and intellectual property

All content on the Site — including articles, reviews, interviews, features, photographs, illustrations, designs, logos and all other original material (“Content”) — is owned by us or our licensors and is protected by copyright, trade mark and other intellectual property laws. All rights are reserved.

You are permitted to use the Site and its Content for your personal, non-commercial use only. You may print or download extracts of pages for this purpose. Any other use is strictly prohibited. You agree not to copy, reproduce, transmit, publish, broadcast, sell, licence, distribute, commercially exploit, or create derivative works from any Content without our prior written consent.

Short quotes of under 50 words may be used for editorial or commentary purposes, provided they are clearly attributed to Music & Gigs with a link to the original article.

4. User-submitted content

By submitting any content to the Site — including comments, pitches, photographs or any other material (“User Submissions”) — you grant us a non-exclusive, royalty-free, perpetual, worldwide licence to use, publish, reproduce, modify, adapt, and distribute that content in any media, for any purpose.

By submitting content you confirm that:

  • You own or have the right to submit the content and to grant the rights described above
  • The content does not infringe any third party’s intellectual property rights, privacy rights or any other rights
  • The content does not violate any applicable law or regulation
  • The content is not defamatory, libellous, obscene, threatening, or otherwise unlawful

We do not endorse any User Submission or any opinion expressed within it. We reserve the right to remove any User Submission at any time, without notice, at our absolute discretion.

5. Affiliate disclosure

Music & Gigs participates in affiliate programmes with ticket providers including Ticketmaster, Eventfinda and See Tickets. When you purchase tickets through links on the Site, we may receive a small commission at no additional cost to you. This does not affect the price you pay and does not influence our editorial decisions about which events to list or cover.

6. External links

The Site contains links to third-party websites including ticket providers, streaming platforms, venues and social media platforms. We are not responsible for the availability, content, accuracy or privacy practices of any external site. The inclusion of a link does not imply any endorsement by us. We recommend you review the terms and privacy policies of any third-party site before using it.

7. Limitation of liability

To the extent permitted by applicable law, the Site is provided on an “as is” and “as available” basis without any representation or warranty, whether express or implied, including but not limited to warranties of satisfactory quality, fitness for a particular purpose, accuracy, completeness or non-infringement.

We make no warranty that:

  • The Site will meet your requirements or be uninterrupted, timely, secure or error-free
  • Any errors in the Site will be corrected
  • The Site or its servers are free from viruses or other harmful components
  • Any Content on the Site is accurate, complete, reliable or up to date

To the fullest extent permitted by law, we will not be liable — whether in contract, tort (including negligence) or otherwise — for:

  • Any economic losses, including loss of revenue, profits, contracts, business or anticipated savings
  • Any loss of goodwill or reputation
  • Any loss or corruption of data
  • Any indirect, special or consequential loss of any kind, however arising, whether or not foreseeable

Nothing in these Terms excludes or limits our liability for death or personal injury resulting from our negligence, or any liability that cannot be excluded or limited under applicable law.

Gig listings, event details and ticket prices are provided for informational purposes only and are subject to change without notice. We accept no liability for cancelled events, postponements, venue changes or any costs incurred as a result of reliance on information published on the Site. Always verify current details directly with the venue, promoter or ticket provider.

8. Indemnity

You agree to fully indemnify, defend and hold harmless Music & Gigs, its contributors, employees and representatives against all claims, liability, damages, losses, costs and expenses (including reasonable legal fees) arising out of any breach of these Terms by you, any content you submit to the Site, or any use of the Site by any person using your device.

9. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of New Zealand. Any dispute arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of New Zealand, except that we reserve the right to bring proceedings in any other jurisdiction we consider appropriate.

Nothing in this clause affects the statutory rights of consumers in any jurisdiction that cannot be excluded or limited by agreement. In particular, if you are located in the United Kingdom, you retain all rights afforded to you under the Consumer Rights Act 2015 and any other applicable UK consumer protection legislation, regardless of the choice of law set out above. If you are located in another jurisdiction, you may also have rights under the laws of that jurisdiction that apply to your use of the Site.

10. Severability

If any provision of these Terms is found by a court to be unlawful, void or unenforceable, that provision shall be severed from the remaining Terms, which shall continue in full force and effect.

11. Entire agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and us in relation to your use of the Site and supersede all prior agreements, representations or understandings relating to the same subject matter.

copyright & intellectual property

This section sets out the intellectual property rights that apply to all content on Music & Gigs and governs how that content may and may not be used. Please read it carefully. By accessing the Site you acknowledge and agree to be bound by these provisions.

1. Ownership of intellectual property

All content published on Music & Gigs — including but not limited to articles, blog posts, reviews, interviews, features, videos, audio recordings, photographs, illustrations, graphics, logos, trade marks, service marks, icons, layout, design, source code and all other material (collectively, “Content”) — is the exclusive intellectual property of Music & Gigs or is used under licence from the respective rights holders.

Music & Gigs’ original Content is protected by copyright law in the United Kingdom, New Zealand, and internationally under applicable treaties including the Berne Convention for the Protection of Literary and Artistic Works, the World Intellectual Property Organization (WIPO) Copyright Treaty, and all other relevant domestic and international intellectual property legislation. All rights are expressly reserved.

The Music & Gigs name, logo and all associated trade marks and service marks are the property of Music & Gigs. Nothing on this Site shall be construed as granting any licence or right to use any trade mark without the prior written permission of Music & Gigs.

All rights reserved. Unauthorised reproduction, distribution, modification or republication of any Content on this Site — in whole or in part — is strictly prohibited and may constitute an infringement of copyright and other intellectual property laws, which may result in civil and/or criminal liability.

2. Third-party content and press material

Press photographs, promotional images, artwork and other material supplied to Music & Gigs by artists, record labels, PR agencies, venues, promoters and other third parties are published for editorial purposes only. Copyright in such material remains with the original rights holder or their authorised licensee, as credited. Music & Gigs makes no claim of ownership over third-party supplied material.

Music & Gigs takes reasonable steps to ensure that all third-party material published on the Site has been provided for editorial use and that appropriate credits are displayed. If you believe any third-party material has been published in error or without proper authorisation, please refer to clause 5 below.

Video and audio content embedded from third-party platforms including YouTube and Spotify is subject to the terms and conditions of those respective platforms. Music & Gigs does not host such content directly and accepts no liability in connection with it.

3. Permitted use

Subject to the restrictions set out in clause 4, you are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Site and its Content solely for your personal, non-commercial use, subject to the following conditions:

  • You must not remove, alter or obscure any copyright notice, trade mark notice or other proprietary notice contained in or attached to any Content
  • You may print or download a single copy of individual pages from the Site for personal reference, provided all copyright and proprietary notices are retained
  • You may share links to articles on the Site freely, provided the link directs users to the original page on Music & Gigs and is not used in a misleading or defamatory context
  • You may quote up to fifty (50) words from any single article for the purposes of commentary, criticism or review, provided the quotation is clearly attributed to Music & Gigs with a hyperlink to the original article
  • You may embed Music & Gigs social media posts where the relevant platform’s own terms and conditions permit such embedding

This licence does not include the right to: collect or harvest any personally identifiable information from the Site; use the Site or its Content for any commercial purpose; engage in any systematic or automated data collection, scraping, mining or extraction from the Site.

This licence is conditional upon your continued compliance with these Terms and may be revoked at any time without notice if you breach any of these Terms.

4. Prohibited use

Without limiting the generality of clause 3, the following are expressly prohibited without the prior written consent of Music & Gigs:

  • Reproducing, copying, publishing or redistributing any Content in any form or by any means — electronic, mechanical, photocopying, recording or otherwise — in whole or in substantial part
  • Modifying, adapting, translating or creating derivative works from any Content
  • Republishing or redistributing any Content on any other website, publication, platform or service, whether for commercial purposes or otherwise
  • Selling, licencing, sublicencing or otherwise commercialising any Content
  • Using any Content in any manner that suggests an association with, or endorsement by, Music & Gigs or any artist, label or individual featured on the Site
  • Framing or mirroring any part of the Site on any other website without our prior written consent
  • Using the Music & Gigs name, logo or any associated trade marks or branding in any way without prior written permission
  • Using any photographs published on the Site for any purpose, commercial or otherwise, without the written permission of the relevant rights holder
  • Systematic downloading or scraping of Content using automated tools or processes

Any use of Content beyond what is expressly permitted in clause 3 constitutes infringement of Music & Gigs’ intellectual property rights and/or those of the relevant third-party rights holders, and may result in legal action.

5. Copyright infringement — reporting and takedown

Music & Gigs respects the intellectual property rights of others and expects all users to do the same. We respond promptly to clear and legitimate notices of alleged copyright infringement.

If you are a copyright owner or an authorised representative and you believe in good faith that any Content on the Site infringes your copyright or other intellectual property rights, please submit a written notice to us containing all of the following information:

  • Identification of the rights holder:your full name, postal address, telephone number and email address
  • Identification of the infringed work:a description of the copyrighted work or other intellectual property you claim has been infringed, including any registration details where applicable
  • Identification of the infringing material:the specific URL or URLs on the Site where the allegedly infringing material appears, with sufficient detail for us to locate it
  • Statement of good faith:a statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law
  • Statement of accuracy:a statement that the information in your notice is accurate and that you are the copyright owner or are authorised to act on behalf of the copyright owner, and that you understand that submitting a false or misleading notice may result in legal liability

Please mark your subject line clearly: “Copyright Infringement Notice”. We will acknowledge receipt within 5 working days and will take appropriate action, which may include removal of the allegedly infringing material pending investigation.

Please note that submitting a false, misleading or bad-faith infringement notice may expose you to legal liability including claims for damages, costs and legal fees. We reserve the right to seek such remedies in appropriate circumstances.

6. Counter-notification

If you believe that material you submitted to the Site was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to us containing the following information:

  • Your full name, postal address, telephone number and email address
  • Identification of the material that was removed and the location where it appeared before removal
  • A declaration that the information provided is accurate to the best of your knowledge and belief, and that you have a good faith belief the material was removed as a result of a mistake or misidentification
  • A statement that you consent to the jurisdiction of the courts of New Zealand and that you will accept service of process from the person who submitted the original infringement notice
  • Your physical or electronic signature

We will process counter-notifications in accordance with applicable law and will notify the original complainant accordingly.

7. User-generated content licence

By submitting any content to the Site — including but not limited to comments, photographs, video clips, written contributions or any other material (“User Content”) — you represent and warrant that:

  • You are the sole owner of all intellectual property rights in the User Content, or you have obtained all necessary licences, rights, consents and permissions to submit it and to grant the rights described below
  • The User Content does not infringe any copyright, trade mark, trade secret, privacy, publicity or other intellectual property or proprietary right of any third party
  • The User Content does not violate any applicable law or regulation
  • You have obtained the consent of any identifiable individual featured in the User Content to its publication on the Site

By submitting User Content, you grant to Music & Gigs a non-exclusive, royalty-free, perpetual, irrevocable, worldwide licence (with the right to sublicence) to use, reproduce, adapt, modify, publish, distribute, publicly perform, publicly display and create derivative works from that User Content, in any media now known or hereafter developed, for any purpose connected with the operation and promotion of the Site.

You retain ownership of your User Content. The licence granted above does not transfer ownership to Music & Gigs. Music & Gigs does not claim ownership over User Content you submit.

We reserve the right to remove any User Content at any time, without notice, at our absolute discretion, including where we receive a valid infringement notice or where we consider the content to violate these Terms or any applicable law.

8. Permission requests

Any request to use Music & Gigs Content beyond the permitted use described in clause 3 — including syndication, republication, licensing, or use in commercial, educational or broadcast contexts — must be submitted in writing. We consider all such requests on a case-by-case basis and reserve the right to refuse or impose conditions.
